Privacy Policy
This Privacy Policy describes how [ATTORNEY: insert legal entity name] (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with the website at vibecodingagency.com and the Services. By using the Services, you consent to this Privacy Policy. If you do not agree, do not use the Services.
1. Information We Collect
We collect only the information reasonably necessary to provide and improve the Services, communicate with you, and process payments. This may include:
- Account Information: Name, email address, billing address, payment method details, company name, and authentication credentials.
- Usage Information: IP address, browser type, device identifiers, pages visited, time spent, referral URLs, and similar analytics data.
- Service Data: Prompts, code, configurations, models, logs, and other content you submit to or generate through the Services (“User Data”).
- Communications: Emails, support tickets, and other messages you send us.
We do not intentionally collect sensitive personal information unless you voluntarily provide it. We do not knowingly collect information from children under 16.
2. How We Use Information
We use the information we collect to:
- Provide, maintain, secure, and improve the Services;
- Process transactions and send billing notices;
- Communicate with you about your account, updates, and support requests;
- Monitor usage, detect abuse, enforce our Terms, and comply with legal obligations;
- Analyze aggregated, de-identified usage trends to improve the Services.
We do not sell personal information. We do not use your User Data to train third-party AI models unless you expressly authorize it in a separate agreement.
3. AI Training and Data Flywheel
UltraWork and other Services may offer an optional setting that allows us to use your consented conversations to train, evaluate, and improve our own AI models and Superintelligence-as-a-Service (“SIaaS”) offerings. This program is governed by the following rules:
- Opt-in only: We only use your conversations for model training if you have explicitly opted in through the UltraWork chat settings. The default setting is off.
- Redaction: Before any consented conversation is added to a training or evaluation dataset, we apply automated redaction for common personal identifiers such as email addresses, phone numbers, Social Security numbers, payment card numbers, and key-like tokens.
- Per-product scope: Your opt-in applies to the specific Service through which you provided consent. It does not authorize us to use data from other Services unless you separately opt in there.
- Retention: Raw conversation traces are retained in hot storage for up to 30 days; redacted, consented examples may be retained indefinitely for model training, evaluation, and benchmarking.
- Withdrawal: You may withdraw your opt-in at any time in the UltraWork chat settings. Withdrawing consent stops future conversations from being used, but does not remove data already incorporated into an anonymized or redacted dataset.
If you do not opt in, your User Data is not used for training or improving our own AI models except as necessary to provide the Services to you, such as formatting or caching responses during an active session.
4. How We Share Information
We may share information with:
- Service Providers: Payment processors, hosting providers, analytics providers, email services, and neocloud GPU providers that perform services on our behalf.
- Legal and Compliance: Law enforcement, regulators, or other third parties when required by law, court order, or to protect our rights, property, or safety.
- Business Transfers: A successor entity in connection with a merger, acquisition, or sale of assets, subject to confidentiality obligations.
We may share aggregated or de-identified information that cannot reasonably identify you.
5. Cookies and Analytics
We and our service providers may use cookies, web beacons, and similar technologies to operate the site, remember preferences, understand usage, and improve the Services. You may disable cookies through your browser settings, but some features may not function properly. [ATTORNEY: add cookie consent banner language if required for EU/UK/California visitors.]
6. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect information. However, no method of transmission or storage is 100% secure. You are responsible for maintaining the security of your account credentials and for any User Data you submit. We are not liable for any unauthorized access, loss, or disclosure of your information or User Data, except to the extent caused by our gross negligence or willful misconduct. [ATTORNEY: review under Texas law.]
7. Data Retention
We retain information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated User Data by contacting us. We may retain certain information as required by law or for legitimate business purposes such as fraud prevention and security. Raw conversation traces used for the AI training data flywheel are retained in hot storage for up to 30 days; redacted, consented examples included in a golden dataset may be retained indefinitely for model training, evaluation, and benchmarking.
8. Your Rights and Choices
Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, or port your personal information, or to object to certain processing. You may also withdraw your AI training opt-in at any time through the UltraWork chat settings. Withdrawing consent stops future data collection but does not remove data already incorporated into an anonymized or redacted dataset. To exercise these rights, contact us at hello@vibecodingagency.com. We will respond in accordance with applicable law. [ATTORNEY: confirm rights language for Texas, CCPA/CPRA, GDPR, and other applicable regimes.]
9. International Data Transfers
The Services are operated from the United States. If you access the Services from outside the United States, you consent to the transfer, storage, and processing of your information in the United States and other jurisdictions where our service providers operate. These jurisdictions may have data protection laws different from those in your country. [ATTORNEY: add SCCs or other transfer mechanisms if serving EU/UK/EEA customers.]
10. No Guarantee of Privacy or Security
TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES REGARDING THE PRIVACY, SECURITY, CONFIDENTIALITY, OR INTEGRITY OF ANY INFORMATION TRANSMITTED THROUGH OR STORED ON THE SERVICES. YOU ASSUME ALL RISK OF UNAUTHORIZED ACCESS, DISCLOSURE, LOSS, OR MISUSE OF YOUR INFORMATION AND USER DATA.
11. Third-Party Links and Services
The Services may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties. We are not responsible for their privacy practices or content.
12. Changes to This Privacy Policy
We may update this Privacy Policy at any time. The updated version will be posted on this page with a revised effective date. Your continued use of the Services after changes are posted constitutes your acceptance.
